TIPS TO SUCCESS
Selection criteria - Skilled Worker Class
Pursuant to Regulation 77, these requirements and criteria
must be met at the time the application is made, as well as at
the time the visa is issued.
Evidence of language proficiency
Pursuant to Regulation 77, points for the applicant's language
proficiency are awarded according to evidence provided at the
time the application is made, if further study, training, or
testing is completed and do***entation submitted between
application and *****sment, officers will use this to
determine point allocations.
For the IELTS reading and writing tests, there are 'General
Training' and 'Academic' options. The 'General Training'
tests
are accepted for CIC purposes.
Officers cannot override the test results and substitute their
own evaluation of language abilities.
Other written evidence
If the applicant provides a written explanation and sup****ting
do***entation in lieu of test results, officers must *****s it
against the Canadian Language Benchmarks 2000, and/or the
Standards Linguistiques Canadiens 2002. See www.language.ca

The onus is on the applicant to satisfy the officer of claimed
language proficiency. Although it is expected that local
knowledge will be invaluable in developing language
proficiency profiles, the following guidelines are intended to
assist officers in making language proficiency decisions.
=B7 Where the applicant has been raised, educated and employed
in an environment where one of the official languages is in
predominant use, a written explanation will usually suffice
to establish high proficiency in that language.
=B7 In situations where an applicant may claim some expertise in
an official language primarily through education and/or
employment, officers will make use of knowledge of local
conditions to assist them in *****sing the validity of such
claims. This knowledge may be enhanced by regular liaison
with local chapters of approved language testing
organizations, who may have developed, over time, clear
indicators and profiles of English / French proficiency in
that locale.
=B7 Given the detailed nature of the Canadian Language
Benchmarks and the Standards Linguistiques Canadiens, it
should be clear that, in most cases where language
proficiency is not patently obvious from the applicant's
background, self-serving declarations, third party
testimonials and/or other claims not sup****ted by detailed
and objective evidence will be of little probative value in
establi****ng high or moderate proficiency.
Interviews
In most cases, officers should be able to make selection
decisions - both to approve and to refuse applications - from
the do***entation provided. However, in some cases, interviews
may be necessary.
Officers may conduct interviews with applicants to:
=B7 ensure that information submitted on the form is truthful
and complete;
=B7 detect and deter fraudulent information and do***ents;
=B7 clarify specific information.
Requirement for truthfulness
withholding or misrepresenting information that is material to
their applications may result in the refusal of that
application under A40(1), thereby rendering them inadmissible
for entry into Canada for two years after that refusal.
