Ever heard of the 14th amendment "equal protection under the law"?
All they have to do is say that a school must meet certain conditions
to be eligible for vouchers. One of those conditions could be
non-restrictive admissions.
There are school qualifications in the Milwaukee voucher program.

<(a) The private school’s method for ensuring that, except for

<their siblings, pupils will be accepted on a random selection basis

<FEES. (a) A private school participating in the Milwaukee
<parental choice program may only charge pupils participating
<under the program fees that may be charged by public schools to
