Passing students that should not be passed

I have a son that is 16 years old and going into the 10th grade yet he has
a 
hard time spelling his OWN name.  I asked him the state capitol of
Michigan 
(the state we live in) and he said it was FLINT!!  (its Lansing)

He is actually about the 4th to 5th grade level in reading, writing, and 
math as well as most other subjects.  I have asked the school WHY they are

passing him all the time and they simply state that because he is "special

ed" and because of that the standards are lower?

I am getting frustrated at how to deal with this, I am the "custodial 
parent" of him and am concerned on how the FOC may feel about pu****ng him 
back 2 grades at the begining of the school year.
